Terms of Use

These Terms of Use ("Terms") govern your use of the Hush mobile application and website (the "Service"), operated by Ember Ventures Ltd ("Hush", "we", "us"). By using the Service you agree to these Terms.

1. What Hush is — and isn't

Hush provides AI-assisted interpretations of infant cries and behavior for informational and educational purposes only. Hush is not a medical device and does not provide medical advice, diagnosis, or treatment. Never rely on the Service for medical decisions, and never delay seeking professional medical advice because of something the Service showed you. If you believe your child may be unwell or in danger, contact a doctor or emergency services immediately. Always trust your own judgment and your pediatrician over any output of the Service.

2. Accounts

An account is optional for core features. You are responsible for the accuracy of information you provide and for keeping your credentials secure. You may delete your account at any time from within the app (Settings → Delete account), which permanently removes your account and associated cloud data.

3. Subscriptions

Hush Plus is an auto-renewing subscription (weekly or annual) purchased through the Apple App Store or Google Play. Where offered, a free trial converts to a paid subscription unless cancelled before the trial ends. Payment is charged to your store account, and subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your device's store settings. Prices are shown before purchase and may vary by region.

4. Your content

Videos and audio you capture are used to generate your analysis. You retain ownership of your content and grant us the limited licence needed to process it and operate the Service. You confirm you have the right to record the child featured and are their parent or legal guardian, or have the guardian's permission.

5. Acceptable use

• Do not use the Service unlawfully, or to harm any person.
• Do not reverse-engineer, scrape, resell, or interfere with the Service.
• Do not upload content you have no right to use.

6. Disclaimers and liability

The Service is provided "as is" without warranties of any kind. AI outputs are probabilistic and may be wrong. To the maximum extent permitted by law, Ember Ventures Ltd is not liable for indirect, incidental, or consequential damages arising from use of the Service, and our total liability is limited to the amount you paid us in the twelve months before the claim.

7. Changes and termination

We may update the Service and these Terms; material changes will be posted here with a new effective date. Continued use after changes means acceptance. We may suspend or end the Service or your access to it for breach of these Terms.
